Please read this agreement carefully. Becoming a subscriber to Indian Creek Internet Services, Inc. constitutes an agreement to abide by the Terms and Conditions that follow.

Indian Creek Internet Services, Inc. (ICIS) reserves the right to cancel the membership of any subscriber at it's sole discretion. ICIS' liability in such cases shall be limited solely to refunding any advance payments and/or deposits.

ICIS reserves the right to make changes to these policies at any time and will provide notice to you via email and posting to our website. You are responsible for retrieving information sent to you and for providing us with your current email address if it is an address provided by another service (such as Yahoo or Hotmail). Continued use of the service constitutes your agreement to abide by any changes to these policies.

ACCEPTABLE USE

DSL and Wireless users may not use the service in any way that inhibits, restricts or adversely affects the quality of the service to other users or places an undo burden on ICIS' network. This includes but is not limited to excessive bandwidth usage and use of peer to peer file sharing programs. Running any type of server application in connection with using ICIS' services including but not limited to streaming media, http, mail, ftp and irc is strictly prohibited. Any account in violation of these terms is subject to immediate termination.

OTHER PROHIBITED USES

1. Sending unsolicited mass email messages.

2. Attempts to gain access to ICIS' network or any other system or user's private data.

3. Fraudelent addressing including forging, altering or removing electronic mail headers.

BILLING & PAYMENT OPTIONS

Subscribers may pay with credit card, check, or money order.

CREDIT CARD OR AUTOMATIC BANK WITHDRAWAL - Install kit fee and first month's payment must be paid in advance to begin service. Each month's service will be billed on the anniversary date of service for the upcoming month. A receipt will be e-mailed showing the credit card or ACH transaction. It is the subscriber's responsibility to notify ICIS of any changes to credit card number, expiration date or bank account information. The subscriber will be notified via email for any transaction that is declined. Service will be suspended and subject to a reactivation fee for non-payment within 5 days from this notice.

CHECK OR MONEY ORDER - Install kit fee and first month's payment must be paid in advance to begin service. Payment for each month's service is due on the anniversary date that service was started. An e-mail invoice will be sent 5 days prior to the anniversary date. If payment has not been received within 5 days after the anniversary date, service will be suspended and subject to a reactivation fee for non-payment. The customer will be charged a $25 fee for any check that is returned.

CANCELLATION

To cancel monthly service, notice must be submitted to Indian Creek Internet Services, Inc. in writing prior to the anniversary date of service. No pro-rated refunds will be issued.

PERSONAL WEB PAGE SPACE

Space for Personal Web Pages is provided free to DSL account subscribers and may be up to 5mb in size. Any advertising or selling of products or services is prohibited. File transfer is limited to 100MB per month. For web space other than for personal use or higher bandwidth transfer, please contact Indian Creek Internet Services, Inc. for infomation on commercial web site hosting.

INTERNET CONTENT

Indian Creek Internet Services, Inc. is not responsible for content on the Internet. Subscribers are responsible for any material that they may access over the Internet through the use of Indian Creek Internet Services, Inc. Because there is no governing body which has jurisdiction over the Internet, subscribers are warned to use caution to avoid illicit or offensive materials. Parents may want to consider using one of the various content screening applications to monitor their children's use of the Internet.

LAWFUL USE

Indian Creek Internet Services, Inc. may be used only for lawful purposes. Transmission or solicitation for reception of material which violates US Federal or Texas State Law, or State Law of the state you reside in, or Local Law of the township you reside is prohibited. This includes material that is threatening, legally obscene, libelous, or violates trade-secret, patent, or copyright protections.

UPTIME

Interruption of service is infrequent, but will occasionally happen. Indian Creek Internet Services, Inc. will attempt to maintain 99% uptime. We will inform our subscribers as early as possible by e-mail of any planned shutdowns and make every effort to schedule maintenance downtime between midnight and 6:00 a.m. Indian Creek Internet Services, Inc. is not responsible for shutdowns which may occur without warning due to upstream or network outages. Indian Creek Internet Services, Inc. is not responsible for any loss including consequential damages resulting from using our services, including but not limited to downtime, delays, or computer viruses.

NO BACKUP SYSTEM

ICIS shall not be responsible for any lost email data including attachments and message contents. ICIS will not perform backups of personal web sites. We recommend that customers regularly backup files on their own computers as well as files stored with us.

This agreement contains the full understanding of the properties with respect to the subject matter herein.
